i have a query in regards to the lodging of a mining permit on a piece of land.

if someone has applied for a permit to mine, but it has not yet been successful, does this mean that in the meantime the land in question is free to prospect on say with a detector or sluice?

taking into account the obvious laws of the land in regard to owners allowing access etc, and the fact that you are not meant to mine anywhere with no permit.

what i mean is that you would not be in conflict with the said applicant of the submitted but not approved permit?

Good question.If the permit had been lodged by a big company I think you would get away with claiming (har har) ignorance but if the claim was a one man band you might have some trouble... Not sure of the legal implications.Perhaps JW can shed some light?

was just curious, i don't want to tread on anyone's toes.

i was going to head upstream from a spot where i know theres gold but have doubts on whether there's any past a certain point. previous mining has not occurred that far out either.

then, blow me down, someone has gone and got a permit on the spot. bloody rough with no easy access too.

nicely said and spot on.

the permit i was talking about i think prob may be rejected actually, if there is such a thing, for a couple of reasons. i'll wait and see. i know the permit team love the applicant fee tho!

I applied for a permit ,waited 8 months ,no feed back on where they were with it,got itchy feet so went and did some sampling because summer was nearly over.DOC reported me to CM for illegal mining,note; i was not on doc ground.CM have now declined my permit.I am only a one man band with small dredge. I,m very peed off.All i was doing was trying to do things all legal and get nowhere.

Hi All
Brought my claim up the wakamarina 5 years ago and had problem after
problem.Glass Earth owns km after km of land up there and two bends of the claim
was over laped with theres....so had to write letter after letter to get this claimed.
Crown Minerals I think need to sort out a better deal for the small scale miner
Anyway once you have a claim it is a great feeling and as you know I have offered
everyone here a chance to fossick on my claim.I have helped out a few but I will have to say
no more.Thoughts of a 8" dredge are in the pipeline and I have a new team member
Steve from here in Blenheim who has contributed alot to the claim and by the few bits
of gold we have collected look out winter dredging.So any questions you have please ask.....Over and out

Hey Ted, heard your news, that sux mate, have you looked into review/appeal?.
Maybe get your MP to look at it, or go straight to Gerry Brownlea.
I wouldn't leave it too long, probably worth a bit of try; the opinion of that chap at the council might help?. Iwi were sorted etc.
There's often an obligation from Govt Depts to 'fair justice' and that usually includes timely reply/responding, keeping applicants/clients informed etc; I'd go for flawed-due- process or something?.
As Krazi says, CM have to be more user friendly for the small guy, too many hoops!; We do less damage than a flood.

Not on DoC land!, they should keep their #%@^& noses out of it,....bed-wetters!.
People who get caught dredging without a permit loose less than you have spent.

Those two Chch guys we bumped into were fairly disgusted with the slack attitude re- contact/communication you had been getting....they'd be really spewing at the outcome!.

Anyway, hope you still manage to get in a bit of the yellow stuff.
If you want a bit of a bush-legal consultation....you know where I'm at and what I drink!

Hi there ted that sux....did you have reasorse consent...? if you did that would be a big pluss for you if you were to appeal CM
also did you get a tenement agent to do the paper work for you..?
as iv got a claim and a mate of my,n has a couple we use the same agent and all of them have gone through granted with,n 4 month,s no questions asked.

Yep,i had meet with local council and sorted consent matters.and yep i have written back to CM appealing decision.
